The following terms and conditions must be read having regards to the provisions if the Trade Practices Act (1974) to the extent that those provisions are applicable to consumers as defined under section 4B of that Act. These terms and conditions to not have the effect of excluding, restricting, or modifying rights under that Act which cannot be excluded, restricted or modified by agreement.

Completion of an online order constitutes an offer by you to purchase our goods. Tikidibou Pty Ltd will accept your offer and conclude a sale subject to availability of stock and payment being settled.

All products remain the property of Tikidibou Pty Ltd until they have been paid for by you.

We do not have any liability to you arising from the supply of our products to you, except that we shall provide you with a refund or replace products for you if there are any defects. All warranties and representations are otherwise fully excluded to the extent allowed by law.

Please ensure your credit card details are provided at time of order. Some banks require your Card Verification Code (CVC) to be quoted - this is a 3-digit number located on the rear of your card on the signature band.Please note billing address of card must be provided.

Alternatively, payment can be made direct into our bank account. Email at info@naturaura.com.au to obtain the banking details. Cheques are also accepted but please allow time for clearance of funds.

You will receive an email confirmation once payment has been received.

Prices are correct at time of publication and they are subject to change without prior notice. Where applicable, prices shown do not include the 10% GST.

A deposit of 30% is required, with balance on delivery. We will deliver once payment has been received in full.

delivery

Delivery Area. Deliveries are currently restricted to Melbourne Metropolitan, Sydney Metropolitan and Brisbane Metropolitan (refer to Delivery Areas by Postcode section). Tikidibou Pty Ltd reserves the right to either cancel or charge additional delivery fees on any order where a delivery address is made outside of the above listed delivery area.

Receipt of Goods. Tikidibou Pty Ltd or its transport agents will deliver goods on the presumption, that anyone who receives the goods at the Delivery Address is authorised to receive the goods. Tikidibou Pty Ltd or its transport agents will require a signature and the name of the person accepting delivery as Proof of Delivery.

Title and Risk. Title of Goods passes to you only after cleared payments are received by Tikidibou Pty Ltd. Risk of Goods passes to you upon delivery to the Delivery Address.

delivery and additional delivery fee.

Delivery fee charged is to be paid at the time of invoice. If no one is at the deliver address for collection, Tikidibou or its transport agent will undertake reasonable effort to arrange for re-delivery. Additional delivery fees may apply.

free delivery

To qualify for Free Delivery in the Delivery Area (refer to Delivery Areas by Postcode) a minimum order value or weight applies including GST however excludes delivery fee. Tikidibou Pty Ltd reserves the right to alter the minimum order value or weight, without notice. The current free delivery structure is: Free Delivery applies to Melbourne Metropolitan, Sydney Metropolitan and Brisbane Metropolitan area where minimum order value is AUD 3 000.

•  Sydney Metropolitan deliveries are: 1000-2082, 2084-2234, 2558-2570, 2759-2770, 2740-2756, 2890-2891

• Brisbane Metropolitan deliveries are: 4000-4123, 4127-4132, 4151-4179, 4184-4208, 4300-4305, 4500-4504, 4508, 9000-9587

overdue accounts

No goods will be supplied, and a 15% per month accounting fee will be charged on all overdue accounts.

items not in stock

Should we receive an order for which we are out of stock, we will contact you immediately to offer an alternative product or advise when stock becomes available.

return policy

Tikidibou Pty Ltd will gladly exchange any item you purchase provided it is returned to us unused and in original condition (tags still attached) and packaging within 7 days of your purchase. Please then return the product to us intact, together with the invoice and upon our inspection, we will give you a credit for the cost of the product. Unfortunately we do not refund goods or postage costs. Under no circumstances may goods be returned without approval.

delay

Tikidibou shall not be liable for any delay, forwarding or transit or any consequential loss or loss of market however caused.

limitation of liability

Liability of Tikidibou arising out of any one incident, for breach of warranty implied into these terms and conditions by the Trade Practices Act (1974) or howsoever arising is limited to the supplying of the goods again, subject to their availability, or goods of equivalent price.

Cancellation Terms: In the event of cancellation the following fees will apply.

The date the order is placed is the date that appears on Tikidibou Pty Ltd Pro Format invoice.

• Written notification within 48 hours from the date the order is placed - No Penalties.

• Written notification after 48 hours after the order is placed - Penalty of 10% of the original order.

• Written notification after 28th of February 2011 midnight - Penalty of 50% of the original order.

lost/damaged goods

In the unlikely event that that a product arrives damaged or faulty, contact us on 61 2 8521 7636 or email us at info@tikidibou.com within 7 days of delivery of the goods to arrange a replacement (depending on product availability). Under no circumstances may goods be returned without approval.

Unfortunately, we do not accept returns for wilful damaged articles or damages caused by failing to adhere to washing instructions.

If your products are lost during delivery, we will do our best to replace them as soon as possible (depending upon products availability). In order to confirm that an order has been lost, we must wait until the maximum delivery time has expired before replacing your product.

force majeure

Tikidibou Pty Ltd shall not be in default under the terms of this agreement nor liable for failure to observe or perform in accordance with any provision of this agreement for any reason or cause which could not with reasonable diligence be controlled or prevented by it, including without limitation, war, insurrection, riot, civil commotion, strikes, lock-outs, labour or industrial disputes, acts of God, acts of Governments or flood, storm, tempest, power shortages or power failure, inability to obtain sufficient labour, raw materials, fuel or utilities. During the period of an incident or incidents of "Force Majeure" this agreement shall be suspended and delivery will recommence after the incident or incidents of "Force Majeure" end.

termination

These terms and conditions and any claim or dispute arising out of or in connection with the services and sales of Tikidibou shall be governed and construed in accordance with the laws of NSW, Australia and submitted to the exclusive jurisdiction of the courts of that state. If any provision of this agreement is found to be invalid or unenforceable by a court of law, such invalidity will not affect the remainder of this agreement which will continue in full force and effect.
